2. Purpose and acceptance

These terms of use and sale (the “Terms”) govern the use of the App and the subscription to Giga Premium plans. Downloading or using the App implies full acceptance of these Terms. If you do not accept them, please do not use the App.

3. Description of the service

Giga is an iOS app that helps sort and clean the photo library. It analyzes the user's photo library locally on their device, identifies potentially superfluous items (duplicates, similar photos, screenshots, large videos, screen recordings, old photos), lets the user build a selection, and then delete the retained items after confirmation.

4. Requirements

The App requires a compatible iPhone running a supported iOS version, and photo library access granted through iOS. Without this access, the sorting features cannot work.

5. Free plan and Premium subscriptions

5.1 Free plan

The App can be used free of charge within certain limits, notably a cleaning volume capped per rolling seven-day period and restricted access to some sorting modes. The applicable limits are indicated in the App and may change.

5.2 Giga Premium subscriptions

Giga Premium removes these limits. Two plans are offered as of the latest update of these Terms:

The applicable prices are those displayed in the App and on the App Store at the time of purchase; they may vary by country and may be changed for future periods, with prior notice through the App Store.

5.3 Billing, renewal and cancellation through Apple

Subscriptions are purchased, billed and managed exclusively by Apple through the user's App Store account, in accordance with the Apple Media Services terms. Consequently:

5.4 Right of withdrawal

In accordance with Article L.221-28 1° of the French Consumer Code, the 14-day right of withdrawal does not apply to digital content supplied immediately with the consumer's express consent and waiver of that right — a consent collected by Apple at the time of purchase. Apple may nevertheless, under its own policy, grant refunds within 14 days of purchase.

We do our best to provide a reliable service and accurate figures. However:

Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, nor the statutory guarantees benefiting consumers (French legal guarantee of conformity for digital content and services, Articles L.224-25-1 et seq. of the Consumer Code).

8. Intellectual property

The App, its brand, interface, texts and graphic elements are protected by intellectual property law and remain our exclusive property. The user is granted a personal, non-exclusive and non-transferable license to use the App on their iOS devices, also in accordance with Apple's standard Licensed Application End User License Agreement (EULA). The contents of the user's photo library remain, of course, their full and entire property.

9. Personal data

Data processing is described in our Privacy Policy, which forms an integral part of these Terms. In short: photos are processed only on the device and are never transmitted; only anonymous usage statistics and subscription-validation data are processed online.

10. Changes to these Terms

We may update these Terms, in particular to reflect changes in the service or in regulations. The applicable version is the one published on this page on the date of use; in the event of a substantial change affecting an ongoing subscription, the user will be informed and may cancel before the next term.

11. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, the user is invited to contact us first at maxime.cleev@gmail.com with a view to an amicable resolution.

Failing amicable resolution, the French courts will have jurisdiction under the conditions of ordinary law.

These Terms are also available in French at app-giga.com/conditions. In case of discrepancy, the French version prevails.
